Abstract The purpose of the evaluation was to determine the effects of eliminating plea bargaining for DWI offenses on general deterrence, recidivism, and court operations were studied. Specific indicators of impact on these three areas were identified and methods were developed for measuring the effects of no-plea bargaining on these indicators. A national review was conducted of jurisdictions in which no-plea bargaining laws or policies had been implemented. Fort Smith, Arkansas and Lexington and Louisville, Kentucky were selected for case study sites. The study findings conclude that policy or legislation for the elimination of plea bargaining contributes significantly to the reduction of repeat drunk driving behavior among those convicted of DWI. No negative effects on court operations were detected in the case study sites. Elimination of plea bargaining also appears to contribute, in concert with other anti-DWI measures, to the reduction of drunk driving behavior among the general driving population. /Abstract from report summary page/
